Under the Gun Control Act (GCA), shotguns and rifles, and ammunition for shotguns or rifles may be sold only to individuals 18 years of age or older. All firearms other than shotguns and rifles, and all ammunition other than ammunition for shotguns or rifles may be sold only to individuals 21 years of age or older. Licensees are bound by the minimum age requirements established by the GCA regardless of State or local law. However, if State law or local ordinances establish a higher minimum age for the purchase or disposition of firearms, the licensee must observe the higher age requirement.

ARMORY ESSENTIALS EXPORT POLICY & EXPORT RESTRICTIONS INFORMATION 

The U.S. Department of State's Directorate of Defense Trade Controls, the U.S. Department of Commerce's Bureau of Industry and Security, and the U.S. Department of the Treasury's Office of Foreign Assets Control administer export control regulations that affect some aspects of our business. We request that you (the "Customer") read and familiarize yourself with the following regarding certain applicable export regulations.

The sale, transfer, transportation, or shipment outside of the U.S. of any product prohibited or restricted for export without complying with U.S. export control laws and regulations, including proper export licensing, documentation or authorization, is strictly prohibited and may result in civil penalties and/or constitute a federal crime. ARMORY ESSENTIALS LLC will not engage in any transaction that requires the illegal export of any products and will not assist directly or indirectly with the illegal export or re-export of any products. An accurate Automated Export System (AES) filing must be made, whether or not the exportation requires a license.

If you wish to purchase an item for ultimate shipment or use outside of the United States, please indicate this fact in your order. Depending on the value of the order, specific item(s), end user, country of ultimate destination and end use, ARMORY ESSENTIALS LLC may be required to apply for an export license with the appropriate U.S. government agency. Several items on the ARMORY ESSENTIALS LLC website may require an export license, including, but not limited to, the following:

Export Policy and Restrictions - Published Policy

International Traffic in Arms Regulations (ITAR):

Some of the item(s) on this website are subject to the International Traffic in Arms Regulations (ITAR), and export is strictly prohibited without authorization or a license issued by the U.S. Department of State's Directorate of Defense Trade Controls. By proceeding with a transaction to purchase any ITAR restricted item(s), the Customer certifies that (i) the purchase does not require ARMORY ESSENTIALS LLC to export such items, unless ARMORY ESSENTIALS LLC is aware of the export and has obtained the appropriate U.S. Government authorization; (ii) the Customer does not intend to export such items after receipt from ARMORY ESSENTIALS LLC without the appropriate U.S. Government export authorization; (iii) the Customer does not intend to export, transfer, sell, or furnish the item to any foreign person, whether abroad or in the U.S., including any Foreign Embassy in the U.S., without the appropriate U.S. Government export authorization; (iv) the Customer understands that a foreign person under the ITAR § 120.16 means "any natural person who is not a lawful permanent resident as defined by 8 U.S.C. § 1101(a)(20) or who is not a protected individual as defined by 8 U.S.C. § 1324b(a)(3)," and can mean "any foreign corporation, business association, trust, society, or any other entity or group that is not incorporated or organized to do business in the U.S., as well as international organizations, foreign governments, and any agency or subdivisions of government (e.g. diplomatic missions)" (See ITAR § 120.16); (v) the Customer is a U.S. Person as defined by ITAR § 120.15, meaning the Customer is a lawful permanent resident of the U.S., as defined by 8 U.S.C. § 1101(a)(20), or is a protected individual as defined by 8 U.S.C. § 1324b(a)(3), or is a "corporation, business association, partnership, society, trust, or any other entity, organization or group that is incorporated to do business in the U.S., or is a governmental (federal, state, or local) entity" (See ITAR § 120.15).

Export Administration Regulations (EAR):

Some of the item(s) on this website are subject to the Export Administration Regulations (EAR), and export may be restricted by the U.S. Department of Commerce's Bureau of Industry and Security. By proceeding with a transaction to purchase any restricted item(s), the Customer certifies that (i) the purchase does not require ARMORY ESSENTIALS LLC to export such items, unless ARMORY ESSENTIALS LLC is aware of the export and has obtained the appropriate U.S. Government authorization; (ii) the Customer does not intend to export such items after receipt from ARMORY ESSENTIALS LLC without the appropriate U.S. Government export authorization.

Important Export Restrictions Warning!

1. Export of some ARMORY ESSENTIALS LLC products is strictly prohibited without a valid export license issued by the U.S. Department of State, in accordance with International Traffic in Arms Regulations (ITAR) (22 C.F.R. 120-130) or a valid export license issued by the U.S. Department of Commerce, in accordance with the Export Administration Regulations (EAR) (15 C.F.R. 730-774).

2. U.S. law prohibits the sale, transfer, or export of items to certain restricted parties, destinations, and embargoed countries, as identified on lists maintained by the U.S. Department of State, the U.S. Department of Commerce, and the U.S. Department of Treasury. It is the responsibility of the Customer to be aware of these lists, which can be found at the following U.S. Government websites. By proceeding with any transaction, the Customer certifies that the Customer will not engage in any unauthorized transaction involving the export of ARMORY ESSENTIALS LLC products to any restricted parties or destinations.

**By proceeding with a transaction to purchase any items from ARMORY ESSENTIALS LLC, the Customer certifies that it will comply with all requirements imposed by all applicable laws, regulations and administrative policies.**

U.S. Federal, State and Local Laws / Regulations and Product Restrictions

ARMORY ESSENTIALS LLC, offers several items that are restricted for sale in the United States of America by federal, state, and/or local laws and regulations. Sale of these restricted items may be limited to United States Military, Law Enforcement, Correctional Facility Personnel, Security Guards, Peace Officers, and various other authorized users.

ARMORY ESSENTIALS LLC makes its best effort to ensure that it remains current on all laws and regulations as applicable. Please be aware that United States federal, state, and/or local laws and regulations are complex and are subject to change. Items regulated by United States federal, state, and/or local laws and regulations may include, but are not limited to, Ammunition, Body Armor, Helmets, Shields, Entry Tools, Lasers, Batons, Insignia, Restraints, Handcuffs, Gun Accessories and Gun Parts, Knives, Automatic Knives, Pepper Spray, and Stun Guns. Purchase of any restricted item may require various documents, including, but not limited to, a purchase order on department or institution letterhead, an official identification, and/or additional certification forms. ARMORY ESSENTIALS LLC expressly reserves the right to require any documentation as it deems necessary to ensure compliance with any applicable laws and regulations or any other purpose. Further, Heart of Texas Armory, Inc.'s reservation of rights includes, but is not limited to, the right to require end user and end use information and/or compliance certification forms from any Customer.

By proceeding with a transaction to purchase any restricted item, the Customer certifies that (i) the Customer has reviewed all United States federal, state, and/or local laws and regulations related to the use, possession, purchase and/or ownership of the restricted item(s); (ii) the Customer is legally permitted to use, possess, purchase and/or own the restricted item(s); (iii) the Customer does not intend to transfer the item(s) contrary to United States federal, state, and/or local laws and regulations; (iv) the item(s) will be used for lawful purposes only, and the Customer is not associated with any criminal group or criminal enterprise; (v) the Customer is at least 18 years of age, or of the appropriate legal age for an item according to applicable federal, state, and/or local laws and regulations; (vi) the Customer is under no legal disability that would prevent the Customer from using, possessing, purchasing, owning, and/or transferring the item(s); and (viii) the Customer has read and understands the Export Policy; and (ix) if applicable, Customer understands and agrees to restrictions on the return of certain regulated products.

By purchasing any item from ARMORY ESSENTIALS LLC, the Customer certifies that the Customer will comply with any and all requirements imposed by applicable U.S. federal, state, and local laws, regulations, and administrative policies.

ARMORY ESSENTIALS LLC does not manufacture, produce or assemble the products or items. ARMORY ESSENTIALS LLC is not responsible for any claims relating to infringement by the product of third party intellectual property rights. ARMORY ESSENTIALS LLC makes no warranties, express or implied, with respect to the quality of the products or the results that customer may achieve utilizing such products, including, but not limited to, the implied warranties of merchantability and fitness for particular purpose (to the extent applicable) which are hereby disclaimed and excluded. In no event will ARMORY ESSENTIALS LLC be liable to Customer for any lost profits or indirect, incidental, consequential, special, exemplary or punitive damages. ARMORY ESSENTIALS LLC liability is limited to replacing defective goods. Pursuant to the provisions of the California Song-Beverly Consumer Warranty Act, this product is sold "AS IS" and "WITH ALL FAULTS".

By purchasing Ammunition from ARMORY ESSENTIALS LLC, you certify that you have read and understand the following:

1. You have reviewed all United States federal, state, and/or local laws and regulations related to the use, possession, purchase and/or ownership of the item and you are legally permitted to use, possess, purchase and/or own the ammunition.

2. You are over twenty-one (21) years of age

3. Your purchase is in compliance with 18 USC § 922, certain portions are as follows--

4. It shall be unlawful for any person

5. who has been convicted in any court of, a crime punishable by imprisonment for a term exceeding one year;

6. who is a fugitive from justice;

6. who is an unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802 ));

7. who, being an alien--

8. is illegally or unlawfully in the United States; or

9. except as provided in subsection (y)(2), has been admitted to the United States under a nonimmigrant visa (as that term is defined in section 101(a)(26) of the Immigration and Nationality Act ( 8 U.S.C. 1101(a)(26) ));

10. who has been discharged from the Armed Forces under dishonorable conditions;

11. who, having been a citizen of the United States, has renounced his citizenship;

12. who is subject to a court order that--

13. was issued after a hearing of which such person received actual notice, and at which such person had an opportunity to participate;

14. restrains such person from harassing, stalking, or threatening an intimate partner of such person or child of such intimate partner or person, or engaging in other conduct that would place an intimate partner in reasonable fear of bodily injury to the partner or child; and

15. who, b(C)(i) includes a finding that such person represents a credible threat to the physical safety of such intimate partner or child; or an alien--

16. by its terms explicitly prohibits the use, attempted use, or threatened use of physical force against such intimate partner or child that would reasonably be expected to cause bodily injury; or

17. who has been convicted in any court of a misdemeanor crime of domestic violence, to ship or transport in interstate or foreign commerce, or possess in or affecting commerce, any firearm or ammunition; or to receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce.

18. It shall be unlawful for any person who is under indictment for a crime punishable by imprisonment for a term exceeding one year to ship or transport in interstate or foreign commerce any firearm or ammunition or receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce.
